Luxembourg Unemployment Benefits: Eligibility, Amount and Application

After a job ends in Luxembourg, the first distinction is residence. A resident may seek full unemployment benefit from ADEM. A cross-border worker normally claims in the country of residence, even when the former employer was in Luxembourg. Confusing those routes can cost valuable time during a four-week application window.

For a resident, the order matters: register as a jobseeker, wait for ADEM's eligibility screening and invitation, then submit the authenticated MyGuichet application. Since 1 January 2026, the benefit claim itself is exclusively online. ADEM offers assistance to people who cannot complete it alone.

Who normally qualifies

The standard resident claim covers salaried workers aged 16 to 64 who live in Luxembourg, lost their job involuntarily, are fit for work and remain available to accept suitable employment. A mutual termination, resignation without good reason or dismissal for serious misconduct normally does not qualify. Specific contested-dismissal or serious-reason cases can have a temporary court-linked route, but they require prompt legal action and are not ordinary claims.

The usual work test is at least 182 days under one or more employment contracts during the 12 months before job loss, with extensions to the reference period possible in defined cases. A worker with one contract must generally have worked at least 16 hours a week for the same employer. Multiple-job cases use additional tests concerning hours lost and remaining income. A person who is still medically unfit when employment ends does not start receiving unemployment benefit immediately; fitness for work is required. Directors, managers or holders of a business permit also face special ancillary-income rules and should disclose their position rather than assume automatic exclusion or entitlement.

Register first, then apply within four weeks

Register with ADEM as soon as the end date is known. Jobseeker registration can be started online and requires availability for the Luxembourg labour market. Once the file is open, ADEM uses the registration data to identify likely benefit entitlement. The applicant then receives a letter inviting an online claim in the private MyGuichet space.

The claim must be filed within four weeks from job loss. Authentication requires LuxTrust, a Luxembourg eID or a compatible European eIDAS method. The ADEM 2026 notice confirms the online-only process. Prepare an IBAN document with bank name and BIC, the latest employment contract and, when applicable, the dismissal or termination letter. The 85% child rate needs supporting proof such as family-allowance or higher-education-aid documentation.

How the amount and duration work

The standard benefit equals 80% of qualifying previous gross salary, or 85% for a claimant with one or more children who generate a tax abatement. The base is normally the gross salary over the three months before job loss; in certain circumstances, it can extend to six months. Regular supplements and sick pay can enter the base, while overtime, gratuities and incidental-expense allowances do not.

Those percentages are not a promise of the same net amount. Tax and social contributions are deducted, all paid work must be declared, and a cap applies. Initially, the benefit cannot exceed 2.5 times the unskilled social minimum wage. After more than 182 benefit days in a year, the ceiling falls to twice that wage. Because the wage is indexed, a current individual calculation is more reliable than a fixed euro example.

Duration generally matches the whole months worked in the applicable reference period. Someone with eight qualifying months generally receives eight months of benefit. The ordinary maximum is 12 months, although extensions exist for defined age, disability, employment-measure and long social-insurance histories. Extra working days beyond a complete month can count as another whole benefit month under the official rule.

Ongoing duties and the cross-border route

Entitlement continues only while the jobseeker remains registered, reachable, available and compliant with ADEM appointments. A suitable job or proposed measure cannot be refused without good reason. Illness needs a certificate; travel and personal absence need prior exemption, limited to 25 working days per year. Training, temporary work and any regular or occasional paid income must be declared. Repeated failures can suspend payments or remove entitlement.

A former cross-border worker does not claim Luxembourg benefit. The last Luxembourg employer completes the termination-of-employment attestation; ADEM uses it to issue the U1 information to the competent institution in France, Belgium or Germany.
